Connecticut Data Privacy Act (CTDPA) & State Regulations
Statutory consumer privacy rights, sensitive data protections, and mandatory administrative appeal mechanisms under Connecticut General Statutes (C.G.S.) § 42-515 through § 42-525 (Public Act No. 22-15) for kettletownestate.com.
1. Connecticut Nexus & Civic Data Governance
The Kettletown Botanical Estate proposal is an independent, citizen-led civic feasibility study centered directly in the Town of Southbury, Connecticut. As Connecticut residents and planning analysts presenting research regarding 150 Kettletown Road, we voluntarily adopt and strictly adhere to Connecticut's premier consumer privacy statute: Connecticut Public Act No. 22-15 ("An Act Concerning Personal Data Privacy and Online Monitoring," codified at C.G.S. § 42-515 through § 42-525).
2. Connecticut Consumer Rights (C.G.S. § 42-518)
Connecticut residents possess specific statutory rights regarding personal data collected or processed through this website:
Right to Confirm & Access (C.G.S. § 42-518(a)(1))
You have the right to confirm whether we are processing your personal data and to access such personal data, unless such confirmation or access would require us to reveal a trade secret.
Right to Correct Inaccuracies (C.G.S. § 42-518(a)(2))
You have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing of the consumer's personal data.
Right to Delete (C.G.S. § 42-518(a)(3))
You have the right to delete personal data provided by, or obtained about, the consumer, including submissions to the Community Voices Board or preference surveys.
Right to Data Portability (C.G.S. § 42-518(a)(4))
You have the right to obtain a copy of the consumer's personal data previously provided to us in a portable, readily usable format (JSON or CSV) that allows you to transmit the data to another controller without hindrance.
Right to Opt-Out of Targeted Ads, Sales & Profiling (C.G.S. § 42-518(a)(5))
You have the statutory right to opt-out of the processing of personal data for purposes of: (A) targeted advertising; (B) the sale of personal data; or (C) profiling in furtherance of solely automated decisions that produce legal or similarly significant effects. Because we do NOT engage in targeted advertising, sell data, or perform profiling, your opt-out status is 100% active by default across all pages.
3. Sensitive Data & Children's Privacy Protections (C.G.S. § 42-520)
Under Connecticut law, controllers are strictly prohibited from processing "sensitive data" without first obtaining the consumer's affirmative consent.
Zero Sensitive Data Processing: We do not collect, solicit, or process sensitive data, defined under C.G.S. § 42-515 as: (1) racial or ethnic origin; (2) religious beliefs; (3) mental or physical health condition or diagnosis; (4) sex life or sexual orientation; (5) citizenship or immigration status; (6) genetic or biometric data; (7) personal data of a known child under 13; or (8) precise geolocation data (within a radius of 1,750 feet).
Minors & Children: In full compliance with Connecticut Public Act No. 23-56 (Connecticut's Act Concerning Online Privacy, Data and Safety for Children), we do not knowingly process personal data of children, nor do we sell or target advertising to consumers between 13 and 16 years of age.
4. Response Timelines & Statutory Appeal Process (C.G.S. § 42-519)
Connecticut General Statutes § 42-519 establishes strict administrative procedures for consumer privacy requests and appeals:
We will respond to a verified Connecticut consumer request without undue delay, but not later than forty-five (45) calendar days after receipt of the request. If reasonably necessary, this period may be extended once by an additional forty-five days, accompanied by written notice explaining the reasons for delay.
If we decline to take action regarding your request, we will inform you without undue delay, but not later than 45 days, of the justification for declining action and provide clear instructions on how to appeal our decision.
How to File an Appeal: To appeal a decision, email kettletownestate@gmail.com with the subject line "CTDPA Appeal" within thirty (30) days of receiving our response. Within forty-five (45) days of receiving an appeal, we will inform you in writing of any action taken or not taken, along with a written explanation of the reasons for the decision.
